Persecution based on SOGIESC
Many countries recognize that persecution based on your sexual orientation or gender identity is a valid ground for claiming asylum. You belong to a "particular social group" under the 1951 Refugee Convention.
- You do not need to "prove" your identity with medical or psychological tests.
- You cannot be expected to "hide" your identity to avoid persecution.
- As a youth, the threshold for what constitutes persecution may be lower than for adults.
Your Right to Safety
When you are placed in youth welfare facilities or shelters, you have the right to be protected from discrimination and violence from staff and other residents. If you feel unsafe in a shared facility because of your LGBTQ+ identity, you must report this to your guardian or social worker so you can be moved to a safe environment.
